    Disney is a public area and therefore you can take pictures from anywhere you're allowed to be


    Its not a public area,its private property,they dont even have to let you in the gate if they dont want you there.As for pictures,your allowed to take pictures of anything that is in "the open"...taking pictures of backstage areas,or construction sites behind const. walls isnt "your right" as a guest...

    Good point mike, but if they decide they want to have a rule that you can not take pictures of construcion areas, they can. The way they would enforce the rule would be ejection from the park.

    There would be no discrimination going on as it has nothing to do with age, race, religion gender, disability etc..

    Check your legal rights, I think you were well within them.
    Yeah, he was, but then they'd be within their rights to throw him off the property if they wanted.

    Disney is a public area
    It's private property, with permission to pass revokable at any time. It is not a public area.

    This is more of an enforcement issue and could really become a hassle for Disney. For example, let's say a family want a picture in front of small world, but it is under refurb for the Holiday. Would Disney really stop the family from taking a picture? If they didn't, it would set precedence for everyone else which could have legal bearing.

    Once again, this is more of an enforcement issue. Is security really going to be running around looking at everyone with a camera deciding which pictures are allowable?

    I'm not saying it would be easy to enforce, or that it would even be a good idea. I was simply pointing out that they may create and enforce such a rule if they choose.

    No, it would not. While it is something impossible to enforce and kind of ridiculous anyway, they can allow or disallow whomever they wish on their property.

    No, that applies to certain copyright cases, where not vigorously enforcing a copyright can set a precedent.

    Again, I'm not saying Disney should enforce a rule like this, but the fact is, since they have the right to throw you out of the park at anytime, they have the ability to create and enforce any rule they see fit that doesn't discriminate or violate any laws.

    I want to bring up a couple of points about taking photos over the walls, which I love to see as much as the next person. First, Disney just had a major accident with a fatality. The last thing their lawyers want is someone taking pictures of what is going on behind those walls that may get into opposing counsels' hands. What if a picture shot behind those walls documents some sort of safety shortcut? Even if the photo isn't a smoking gun, a good lawyer can construe any photo as being negative. I agree that documenting smoking guns is useful in our society and within certain limits, should be done. My point is that Disney has a legitimate legal concern behind limiting photos of non-public areas.

    Second, it has been well publicized that Disneyland has been on the list for likely terrorist targets in California. There were videos and pictures found when suspected terrorists were arrested of the parking structure and esplanade. I have seen reports of suspicious people taking extensive photos/videos of nothing. Makes sense that Disney pays attention to these things and wants to regulate them. In all the confusion of a rehab area, something dangerous may get overlooked.

    I wonder if management is taking a new stance to promote a cleaner image. A lot of Disney related web sites, (including MI) have members that take pictures of maintenance related issues or construction. Possibly they figure this as bad show, and they do not want the "uglies" to be shown anymore.
